As a husband/wife employer with no employees does not qualify for a small business health plan. To be eligible for a small business health plan, you must have at least one W2 employee but not more than fifty employees on a business day during the past 1 or 2 fiscal quarters, depending on the carrier, and employ at least one employee throughout the plan year.
If a business did not exist in the preceding calendar year, it must reasonably expect to hire at least one but not more than fifty employees in the current calendar year. They must also hire at least one employee on the first day of the plan effective date.
